Site Assessment and Remediation of Brownfields Industrial Property, Medway, MA

The property is a former textile mill and shoe manufacturing facility with a history dating back to the 1700’s, located in an industrial/ commercial area of a suburban town and had been identified for redevelopment under the State’s Brownfields program

The site has housed a number of businesses dating back to the 18th century, including use in the manufacture of woolens, shoes and various metals processes. The most recent occupant of the property had been subject to foreclosure and had left drums containing hazardous materials related to the manufacture of footwear components. A site assessment indicated that former uses of the property and fill activities at the site had resulted in soil and groundwater contamination including metals, solvents, asbestos and petroleum. Two leaking underground storage tanks and one above ground storage tank were also present on the property.

In the mid 1980’s, after the FDIC had taken control of the property due to foreclosure, the DEP Strike Force was called in to evaluate the site and identified numerous areas of concern.

Norfolk was contacted by the subsequent purchaser of the property to assist in the cleanup of the site and performed an Immediate Removal Action (IRA) at the site to remove numerous barrels containing hazardous materials left by former owners. Subsequent site assessment activities were performed and Norfolk oversaw the removal of one above-ground and two underground storage tanks containing industrial waste and #2 Fuel Oil, and provided LSP services for removal of contaminated soils, hazardous wastes and contaminated fluids from the property.

Following the clean-up, Norfolk prepared application and negotiated on behalf of the client to participate in the Covenant-not-to-sue program under the DEPs Brownfields Program. The application was approved as the first participant in the Massachusetts Covenant not to Sue program.

At the conclusion of the remediation activities, the Norfolk prepared an RAO report to close the file on the property.

Six years after submission of the Response Action Outcome to the DEP, Norfolk participated in negotiations with the DEP regarding the results of a mandatory Activity and Use Limitation (AUL) site audit. Additional site assessment activities were conducted and a revised RAO document was submitted and the site was closed using a Method 3, class A-2 risk assessment, allowing unrestricted use of the property, in August, 2005.
